The present general terms and conditions (the “GTC”) are the conditions applicable to any access, any order and any sale of products made on and from the commercial website www.decayeuxparis.com (the “Website”).
Any access to the Website and/or any order on the Website constitutes full and entire acceptance of these GTC by the customer (hereinafter the “Customer”). It is recommended to save or print the GTC applicable to the order made by the Customer, accessible in particular in the purchase path of the products.
The Site is published by the company “DECAYEUX PARIS STI”, a Simplified Joint Stock Company with share capital of 1 000 000 euros whose registered office is at SAUCOURT – NIBAS – 80390 FRENNESSEVILLE, and registered with the Trade and Companies Register of Amiens under number 615 680 204 and whose intercommunity VAT number is FR89615
For any question concerning your order, DECAYEUX PARIS puts at the Customer’s disposal a Customer Service which can be reached by telephone 03 22 20 74 40.
2. Modification of the General Terms and Conditions
DECAYEUX PARIS reserves the right to modify these GTC at any time, in particular due to legal or regulatory changes or for security reasons. In the event of major changes, DECAYEUX PARIS will notify of such change on the Site and/or by sending emails; however, the Customer remains responsible for checking the content of the Terms and Conditions. In the event of disagreement with their content, the Customer may stop using the Site at any time.
3. Intellectual Property
All right, title, interest and content displayed on the Site (the “Content”) is the property of DECAYEUX PARIS. The Content is protected by French, European and/or international copyright, trademark, patent or other intellectual property laws. DECAYEUX PARIS holds all rights regarding the selection, compilation, assembly, arrangement and improvement of the content of the Site. Notwithstanding the above, DECAYEUX PARIS cannot be held responsible for any content of the Site linked to DECAYEUX PARIS.
4. Use of the Site
Subject to compliance with these GTC, DECAYEUX PARIS grants the Client permission to download, display, view, use and/or print sections of the Site for their personal and non-commercial use only. Any other use is strictly prohibited, without prior written consent from DECAYEUX PARIS.
5. Restrictions on use
The Customer is prohibited from posting or transmitting any content on or from the Site that :
a) contains threats, is defamatory, obscene, indecent, seditious, abusive, insulting, pornographic, abusive, likely to incite racial hatred, discriminatory, threatening, scandalous, a breach of trust or a violation of privacy or could cause inconvenience or embarrassment;
(b) for which it does not hold all the necessary licences or authorisations;
c) constitutes or encourages conduct that could be considered a criminal offence, give rise to civil liability, or otherwise be unlawful or violate the rights of a third person, in any country; or
d) that is technically dangerous, including computer viruses, logic bombs, Trojan horses, worms, destructive components, corrupted data or any other malicious software or data.
6. Product and Price Information
The products sold by DECAYEUX PARIS are described and presented on the corresponding page. DECAYEUX PARIS warns the Customer that this information may contain typographical errors or minor inaccuracies or omissions not affecting the substance of the product. DECAYEUX PARIS reserves the right to correct these errors, inaccuracies or omissions.
For technical reasons, the display of colours, despite the care taken by DECAYEUX PARIS to ensure that it is as correct as possible, may differ from that of the product depending on the screen and/or the material used by the Customer to display it.
The offers are within the limit of available stocks
The prices applied are those appearing on the Site at the time the order is placed by the Customer. Prices are subject to change. The prices are displayed in euros (€) inclusive of VAT and do not take into account the delivery costs of the order (the “Delivery Costs”) which are indicated to the Customer before the validation of the order.
The Customer may sometimes benefit from discounts through discount codes (the “Codes”) which can be used during the purchase process. DECAYEUX PARIS advises the Customer to take care to use the most appropriate Code for his order. It is expressly stated that only one Code can be used per order, and Codes cannot be combined with another offer. The Codes may exclude certain brands and products, at DECAYEUX PARIS’ discretion.
7. Methods of payment
● Credit Cards – After placing an order, the Customer is redirected to a secure banking payment portal, where he must enter the necessary payment data. In this context, no DECAYEUX PARIS employee has access to the Customer’s banking data, which remains entirely in the bank’s hands. Payment by credit card is considered as payment made in advance;
● PayPal – After placing an order, the Customer is redirected to a secure PayPal portal, where he connects to his PayPal account to complete the order. DECAYEUX PARIS indicates that it never has access to the Customer’s PayPal account or any information related to it.
In order to avoid any risk of fraud, DECAYEUX PARIS only delivers products to PayPal addresses verified and linked to the Customer’s PayPal account. If the latter is not sure that his address is verified, he must check this on his PayPal account and possibly proceed before any order.
8. Delivery and reception
DECAYEUX PARIS is committed to doing its best to ship orders as quickly as possible. The delivery is ensured on the territory of Metropolitan France, and Corsica, and any other destination within a maximum of thirty (30) days as from the date of the order. Depending on the transport provider used by DECAYEUX PARIS, the customer can track the delivery status of his order.
In the event that the Customer makes a large order, DECAYEUX PARIS reserves the right to divide it into several parcels and to make several deliveries.
Upon delivery of the order, the Customer must check the conformity and status of his order in the presence of the transport service provider and express, if necessary, all useful reservations concerning apparent defects. If the Customer has not made any reservations, he must contact DECAYEUX PARIS within two (2) calendar days following receipt of the products to alert him of defects. Failing this, any claim relating to a defect resulting from transport will be rejected by DECAYEUX PARIS.
9. Right of withdrawal
The Customer has a period of thirty (30) calendar days from the date of receipt of the product(s) ordered, the date appearing on the carrier’s receipt being proof, to exercise his right of withdrawal without having to justify his decision.

After exercising its right of withdrawal, the Customer returns or returns the product(s) to DECAYEUX PARIS or a designated person it, without undue delay and, at the latest, within fourteen (14) days following the communication of its decision to withdraw. Each product must be returned new and in its original packaging.
DECAYEUX PARIS shall reimburse the Client at the latest within fourteen days following the communication of its decision to withdraw or on the date of return of the product(s) (i.e. the date of receipt of the product(s) by DECAYEUX PARIS, or the date on which the Client provides proof of dispatch of the product(s)). DECAYEUX PARIS proceeds to the refund by using the same means of payment as the one used by the Customer for the initial transaction, except agreement between the parties. In any case, this refund does not cause any costs for the Customer.
For the right of withdrawal to be validly exercised:
● the cancellation must emanate from the same email address as the one used during the order; and
● the product(s) must not have been opened by the Customer, failing which fees will be applied to the Customer, up to 20% of the price of the product(s);
● custom-made products cannot be refunded
● If the returned items are incomplete, damaged or visibly defective, the seller may claim damages.
The Customer shall bear the direct costs of returning the product(s).
10. Legal guarantees
DECAYEUX PARIS is held of the legal guarantee of conformity and that relating to the hidden defects of the sold thing. The Customer is invited to check the conformity of the products received with regard to his order and, in case of defect noted, to contact the Customer Service which will ensure its assumption of responsibility by indicating to him the methods of return and replacement or refunding.
DECAYEUX PARIS will replace or repair the returned product after receipt and examination of the product in question.
The Customer has a period of two (2) years from delivery of the product to act. When repair is possible, the customer can choose between replacement or repair, unless one of the options involves a cost obviously disproportionate for DECAYEUX PARIS compared to the other, taking into account the value of the good or the importance of the defect, in which case DECAYEUX PARIS can choose instead of the Customer.
The Customer is exempted from providing proof of the existence at delivery of the lack of conformity of the product during the twenty-four (24) months following delivery of the product.
The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
11. Personal Account
To order products, DECAYEUX PARIS provides the Customer with the possibility of creating a personal account. If the Customer decides to create it, all personal data provided by the Customer will be saved and will not need to be re-entered in the next order, but will be entered automatically.
To create this account, the Customer must complete the registration form. The Customer can access, update or correct the elements of his personal account by connecting to it.
The Customer undertakes to maintain his access code and identifier and is responsible for all activities carried out from his personal account. DECAYEUX PARIS does not have the means to verify the identity of persons using the Site and will not be held liable for losses resulting from the use of Customer ID and password by a third person due to your negligence.
If the Customer discovers or suspects that his identifier and password have been used in a fraudulent manner, he undertakes to immediately inform DECAYEUX PARIS by email or by phone 03 22 20 74 40.
12. Electronic Invoice
Upon shipment, the Customer receives a confirmation email with an electronic invoice that can be downloaded at any time from his personal account.
14. Force majeure
DECAYEUX PARIS cannot be held responsible for the non-performance of any of its obligations if this results from a case of force majeure, as defined in Article 1218 of the Civil Code, by the Client or by a third party to the contract.
15. Applicable law and competent jurisdiction
These GTC are subject to French law.
Any disputes arising out of or in connection with this contract may be the subject of an amicable solution; the Client may request the intervention of a mediator. If no amicable solution is found, the dispute shall be brought before the French courts with territorial jurisdiction.

If any clause of these GCS is considered invalid, the other clauses shall remain applicable between DECAYEUX PARIS and the Client.
